Foreign Subpoenas

The Uniform Interstate Deposition & Discovery Act, VA Code §8.01-412.8 through §8.01-412.15, provides that a party may submit a subpoena from a court of record from another state to the Clerk of the Circuit Court serving the jurisdiction in which discovery is sought.

To request issuance of a foreign subpoena from the Arlington Circuit Court, the party must submit (1) one original, plus two copies of the foreign subpoena (2) one original, plus two copies of a completed Virginia Foreign Subpoena form (3) a written statement that the law of the foreign jurisdiction grants reciprocal privileges to citizens of the Commonwealth (4) a self-addressed stamped envelope, and (5) the appropriate filing and/or service fee:

Subpoena duces tecum (to produce documents) $36.00

The person or entity being subpoenaed must be located in Arlington County or the City of Falls Church. If you are unsure if the address is within the City, please check using the USPS website.

If requesting sheriff service of the foreign subpoena, please include an additional $12.00. Checks may be made payable to “Clerk of the Circuit Court”.
