In addition, authorize the director of engineering and capital projects, Department of Environmental Services, to execute, on behalf of the County Board, the deed of vacation and all related documents, subject to approval as to form by the county attorney, regarding the ordinance described above.

19. Fiscal Year 2005 Bureau of Justice Assistance Congressionally Mandated Award.

Recommendation: Authorize the County Manager to apply for and accept $63,786 in non-competitive grant funds from the Bureau of Justice Assistance (BJA) under a congressionally mandated award in FY 2005. Contingent upon approval, appropriate $63,786 grant fund revenue to the Police Department for the costs associated with the BJA program in FY 2006.

20. Governing Body Resolution for Local Governments Authorizing the Department of Human Services to Accept a SHARE Shelter Support Grant from the Commonwealth of Virginia Department of Housing and Community Development for FY 2006.

C.M. Recommendation: Authorize the County Board chairman to sign the Resolution for Local Governments to enable the Department of Human Services to receive funds from the Virginia Department of Housing and Community Development.

21. Authorization of additional funds provided by the Commonwealth of Virginia Department of Mental Health, Mental Retardation and Substance Abuse Services for direct services for children that are eligible for Part C of the Individuals with Disabilities Education Act.

C.M. Recommendation: Accept additional funds awarded by the Commonwealth of Virginia Department of Mental Health, Mental Retardation and Substance Abuse Services and appropriate $73,872 from federal grants to the Department of Human Services, Public Health Division, for Fiscal Year 2005.

22. Community Development Block Grant (CDBG) Program Funds for Arlington Community Action Program, Inc. (ACAP) to assume oversight of the computer lab at the Arlington Mill Community Center.

23. Appropriation of funds awarded by the Northern Virginia Gang Task Force.

24. Appropriation of Virginia Department of Fire Programs grant for fire fighting equipment, protective clothing and prevention.

Recommendation: Approve the use permit subject to the conditions in the draft staff report, and amended as follows: 1) Delete condition #18, requiring construction of a sidewalk, and all other references to a sidewalk and planting strip; 2) Amend condition #24 by deleting the second sentence and inserting: "The plan shall be prepared by the applicant's engineer, and presented to the owners of 2223, 2231, 2237, and 2241 North Vermont Street and 4536 North 26th Street, who shall be given at least 10 days to comment to the County while the plan is undergoing county review. The plan shall be" (continue with 'approved by the County Manager...'); and 3) Amend condition #25 to clarify that the plan for landscaping next to the retaining wall may include landscaping on the neighbor's side of the fence, and that this plan should be given to the affected neighbors for comment before being approved by the County.

37. Zoning Ordinance amendment to Sections 1. Definitions and 32. Bulk, Coverage and Placement Requirements to add definitions of lot coverage and main building footprint coverage and to reduce maximum lot coverage for one-family dwelling lots in "R-5," "R-6," "R-8," "R-10," and "R-20" zoning districts. Maximum coverage for these districts is presently 56 percent. Proposed amendment would reduce maximum coverage to 45 percent in "R-5" districts, 40 percent in "R-6," 35 percent in "R-8," 32 percent in "R-10," and 25 percent in "R-20." In addition a new main building footprint coverage maximum would be added at 34 percent in "R-5," 30 percent in "R-6," 25 percent in "R-8," 25 percent in "R-10," and 16 percent in "R-20." A new main building footprint cap would also be set at 2,040 square feet in "R-5," 2,160 square feet in "R-6," 2,400 square feet in "R-8," 3,000 square feet in "R-10," and 3,880 square feet in "R-20." B. U-3120-05-1 Use Permit: Arlington Public Schools, new high school at 1300 N. Quincy St. (Washington Lee High School) (RPC #14-001-001).

P.C. Recommendation: Approve the use permit subject to conditions of the staff report, with a review in one year after the issuance of the first certificate of occupancy for any part of the space, and with the following changes:

  • That any significant change in parking spaces or location of parking shall result in review of the use permit by the Planning Commission and County Board.
  • That the applicant agrees to implement LEED measures to meet Silver certification. If they are unable to meet this certification, that the APS agrees to return to the Planning Commission and County Board. In addition, that a new Condition 31 be added (see italicized language on pages 9-10).
  • That the Cherrydale Citizens’ Association, the Ballston-Virginia Square Civic Association, and the Washington-Lee PTA be specifically referenced in conditions for pre-construction meetings and other public liaison efforts.
  • That the applicant prior to the County Board meeting continue to improve the eastern and southern façades to enhance the public experience of this civic building.
  • That drawings showing the proposed school and the relationship to the single-family houses on Stafford Street be provided for the County Board meeting.
  • That the following be added to the end of Condition 30: A Transportation Demand Management program (including a parking management plan and way-finding signage) be approved by the County Manager prior to the issuance of the sheeting and shoring permit.

Submit a speaker slip to the Clerk; you have up to 2 minutes to speak; only one speaker per topic will be heard. Print a Public Comment Speaker Slip.

B. Consent Agenda: Items removed on Saturday, no earlier than 9 a.m., will be heard at 6:30 p.m. on Tuesday. This will automatically remove the item from the Consent Agenda and carry it over to the following Tuesday Recessed Meeting for public testimony (no speakers will be heard on Saturday). Submit a speaker slip on Saturday, identifying all the Consent Agenda item number(s) you wish to address on one slip; at the Tuesday meeting, individuals and organizations have up to 3 minutes to speak on all matters.
