OFFICE OF THE TREASURER
LITIGATION
PROGRAM MISSION: To represent the
Treasurer in State and U.S. Bankruptcy Courts and to advise the office on legal
matters to ensure that all county taxes and other debts are promptly paid.
The Litigation Division is responsible for filing and litigating all
claims in Bankruptcy court and to aggressively pursue uncollected accounts
through Motions for Judgment in General District Court.
The division is also responsible
for tracking, pursuing and responding to inquiries on judgments; to target
delinquent real estate for sale and to answer legal questions and interpret
statutes and regulations for the office.
The division also works with the Treasurers' Association of Virginia to
reform and enhance tax collection tools and other laws affecting treasurers.

SIGNIFICANT BUDGET HIGHLIGHTS:
The budget for the Litigation Division reflects the separation from the
Compliance Division effective in FY 2003.
-
Because of state
budget cuts affecting funding for the Treasurer's Office, a reduction in
operating expenditures was taken.
-
Increased funding for materials and postage for the
permit parking program which will now permanently reside in the Treasurer's
office budget.

A decrease in State Compensation Board funding. Action was taken by the Compensation Board
by authority of Section 15.2-1636.8 et.seq, Code of Virginia. This action was imposed by the Compensation
Board as a result of new revenue forecasts by the Governor.

Revenue reduction due to decreased parkulator revenue
applied across all Treasurer program budgets.
PERFORMANCE MEASURES:
Objective: To timely and accurately file all bankruptcy
claims, objection to plans and participate in other contested matters to
protect the funds due to the county.
