THE FOLLOWING CASES TO BE HEARD BY PLANNING COMMISSION AND COUNTY BOARD:
Zoning Ordinance Amendment to Sections 1, 2 and 31A of the Arlington County Zoning Ordinance.  Update Section 31A.Historic Preservation Districts, Section 1. Definitions, and Section 2.B. General Provisions. Districts.  Revise Zoning Ordinance to implement goals and policies in adopted 2006 Historic Preservation Master Plan.  End terms of current HALRB members as of midnight, December 31st 2009, and appoint members for new terms.  Section 1 remove definitions from Section 31A, and move them to Section 1, with language amendments, and deletions where terms are archaic or inapplicable.  Section 2 add Historic Preservation District Zoning Overlay (HD) to table in Section 2.B. The amendments to Section 31A would  amend purpose of regulations; establish size for HALRB at 15 members; end current HALRB terms; establish criteria for when member’s appointment is terminated; alter membership criteria; simplify meeting procedures in accordance with requirements of Code of Virginia; codify responsibilities of HALRB; streamline historic district designation process; enumerate standards for historic district designation; eliminate designation and procedure for historic landmarks designation; remove references to actions within or pertaining to historic landmarks, and specify instead actions or references to historic districts; give Zoning Administrator limited authority to reduce setback requirements in accordance with findings made by HALRB pursuant to standards set forth in Ordinance; give HALRB limited authority to approve and amend design guidelines; establish expiration date for Certificates of Appropriateness; establish standards by which HALRB may delegate to their designees (the Historic Preservation Staff) limited CoA issuance authority for certain types of applications; amend standard for County Board review of appeals of HALRB decisions; create new process for ascertaining whether property has been offered for sale at price reasonably related to fair market value; create new Subsection on Transfer of Development Rights (TDRs); and enact other changes where language is archaic or inapplicable.
Zoning Ordinance Amendment to Section 36.H to of the Arlington County Zoning Ordinance to permit, by special exception site plan approval, modification of density regulations, specifically to permit bonus density, for provision of child care centers and community facilities and other minor modifications to language in Section 36. to more accurately reflect specific enabling authority found in Code of Virginia as well as current County practice.

SITE PLAN AMENDMENTS:
SP #105 CLFP-Metropolitan Two Venture, LP for modification to site plan conditions 17 and 18 and modification to location of water fountain, in C-O-2.5 zoning district, under §36.H.  Property is approximately 111,825 sq. ft., at 1221, 1301, and 1311 S. Fern St. (RPC #35-003-006, -007, -008). SP #90 Alion Science and Technology for site plan amendment to modify existing rooftop sign in “C-O” Commercial Office Building, Hotel, and Multiple-Family Dwelling Districts under ACZO § 34.H to modify §34.D1.  Property is approximately 160,829 sq. ft., at 1550 Crystal Dr. (RPC # 34-020-248). ALLOCATION OF STATE PERSONAL PROPERTY TAX RELIEF MONIES

       IT IS HEREBY RESOLVED AND ORDERED by the County Board of Arlington County, Virginia, as follows:
1.     In accordance with the requirements set forth in Section 58.1-3524(c)(2) and Section 58.1-3912(E) of the Code of Virginia, as amended by Chapter 1 of the Acts of Assembly (2004 Special Session 1) and as set forth in Item 503.E (Personal Property Tax Relief Program) of Chapter 951 of the 2005 Acts of Assembly any qualifying vehicle having situs within the County commencing January 1, 2009, shall receive personal property tax relief in the following manner:
•          Qualifying vehicles shall receive 100% tax relief on the first $3,000 of value, and the balance of relief then being equally distributed for each dollar of value up to $20,000 in value.  For any value of a qualifying vehicle in excess of $20,000, there shall be no tax relief.  The relief to be equally “distributed” shall mean the funds provided by the Commonwealth specifically for such tax relief.
•          All other vehicles which do not meet the definition of “qualifying” will not be eligible for any form of tax relief under this program. 
•          Qualifying vehicles defined by the State’s Department of Motor Vehicles as clean special fuel vehicles shall receive 100% tax relief on the first $3,000 of value. These vehicles shall also receive 90% tax relief for each dollar of value between $3,001 and $20,000. For any value of a qualifying vehicle in excess of $20,000, there shall be no tax relief.
2.     In accordance with Item 503.D.1, the entitlement to personal property tax relief for qualifying vehicles for tax year 2005 and all prior tax years shall expire on September 1, 2006.  Supplemental assessments for tax years 2005 and prior that are made on or after September 1, 2006 shall be deemed “non-qualifying” for purposes of state tax relief and the local share due from the taxpayer shall represent 100% of the tax assessable.

         (c)   Manufactured homes as defined in Section 36-85.3 of the Code of Virginia.
      2.    That pursuant to Section 58.1-3506.A.10. there be levied for the calendar year 2009 a tax of $0.868 per $100 of assessed valuation on all manufactured homes as defined in Section 36‑85.3 of the Code of Virginia and pursuant to Section 58.1-2606 on all other tangible personal property of public service corporations based upon the duly certified assessment of the State Corporation Commission.

NOTICE OF PROPOSED REAL PROPERTY TAX INCREASE

The County of Arlington, Virginia, proposes to increase property tax levies.
1. Assessment Increase:  Total assessed value of real property, excluding additional assessments due to new construction or improvements to property, exceeds last year's total assessed value of real property by negative 0.6%.
2. Lowered Rate Necessary to Offset Increased Assessment:  The tax rate which would levy the same amount of real estate tax as last year, when multiplied by the new total assessed value of real estate with the exclusions mentioned above, would be $0.843 per $100 of assessed value.  This rate will be known as “lowered tax rate.”
3. Effective Rate Increase: The County of Arlington, VA, proposes to adopt tax rate of $0.868 per $100 of assessed value. The difference between lowered tax rate and proposed rate would be $0.025 per $100 or 2.9%.  Difference will be known as “effective tax rate increase.” Individual property taxes may, however, increase at percentage greater than or less than above percentage.
4. Proposed Total Budget Increase:  Based on proposed real property tax rate and changes in other revenues, total budget of Arlington will exceed last year’s by negative 1.2%.
5. In addition to the base tax rate, the County proposes to maintain the sanitary district tax at the current rate of $.01 per $100 of assessed value. Revenue from this tax is dedicated for stormwater management purposes.
6. The County also proposes to maintain the real estate tax for properties used for or zoned to permit commercial and industrial uses at the current rate of $.125 per $100. Revenue from this tax is dedicated for transportation initiatives.
PUBLIC HEARING ON THE INCREASE WILL BE HELD ON MARCH 26, 2009, AT 7:00 P.M. The purpose of this amendment is to decriminalize violations of zoning ordinance and make them civil penalties subject to fines as allowed by Code of Virginia, ranging from $200 for initial violation to $500 for subsequent violations up to maximum of $5,000.  The amendment also proposes to make demolition of historic structure without certificate of appropriateness as civil penalty with fine equal to twice assessed value of property.  To facilitate this, amendment to delete criminal sanctions in 31A Historic Districts, is also proposed.  The proposed amendment will retain as criminal violations: signs on public property or rights-of way, land disturbing activity, and any violation that results in physical injury to person.  The proposed amendment allows prosecution of civil violations as criminal violations when maximum civil violation of $5000 has been imposed and violation has not been rectified.  Finally, the proposed amendment allows zoning administrator to seek search warrant to determine if zoning violations have occurred.
